Would the Republican Party allow it's commercials or campaign material to be used in any manner anyone wanted? Given that it is already being packaged in a form they approve of why would they allow someone else to repackage or edit it in an (almost certainly) negative way?
"It's puzzling, then, why Fox won't budge."
This begs the question whether decision-making at Fox proceeds on some sort of rational basis. Maybe the people making these decisions are irrational idiots.

We've seen time and again that it's easy to shut down even clear 'fair use' clips on sites like YouTube. All it takes is a cease and desist letter. Even when presented in bad faith, these letters can be successful at getting content removed without the need for actual litigation.
