Should Mukasey be confirmed as attorney general if he can't say whether waterboarding is torture?

    If Mukasey cannot be honest about this, he should not be confirmed. If he says it's not torture, he can be educated. If he says it is torture, that's fine. But if he cannot say one way or the other, how can he be expected to take a consistent stand vis a vis something the White House wants that violates both the Constitution and human decency abhor? We need someone who has a center, who has values. His ties to Giuliani are already discouraging and I can't see anything that mitigates the connection.
