it becomes more so. Sadly, if a journalist were charged in this way over a story, there would be an uproar.. but here there won't even be MSM coverage.
Glenn - I have reached the point where I just can't take much more of this crap from the Obama administration. The sense of betrayal I feel far surpasses my outrage at the Bush administrations crimes and misdeed. I appreciate what you are trying to accomplish by shedding light in a national forum on these darkest of secrets. I can only hope that there will be a change sometime soon.
Seriously. It is absolutely surreal.
When do we take to the streets with the torches and pitchforks?
The good and bad right next to each other. A historic trip to restore our position in the world, coupled with the cover up of crimes against the constitution.
The Main Stream Media sure spends a lot of time on trivial crimes, but it doesn't seem to cover crimes against our laws. This lack of coverage in the press is another crime because the role of the press is to inform the citizens. We have become shoppers as described in James K. Galbraith's book "The Predator State." It is about economics and politics and lays out the failed economic theories that reinforce the oligarchy who is running things and is so powerful that they can keep doing what they want. Galbraith is interviewed on Cenk Uygur program recently. Another area of Obama's cover up is finance.

Every time I post on gun control, I'm thinking of situations like these. Our government is already unaccountable, and our own (well meaning) citizens want to deprive us of the ultimate check on tyranny. Le sigh.
We are living in a banana republic.
because Glenn wrote about the letter to the President that was redacted and because we read about it, we shall all have to present ourselves to the Ministry of Truth in the morning.
(the judge who just ruled in that Guantanamo matter,) and maybe we can expect justice.
Much thanks, Glenn, for bringing this important story more coverage.
This is totally unacceptable governmental conduct against a whistleblower and attorney working for human rights and against torture. He and his colleagues have broken no law. In fact, they followed the law and are now being punished for it. And this from a government that tried to coerce a pledge of silence from their client as a condition of his release from Guantanamo.
The U.S. wars of conquest and control, mislabeled a "war on terror," have tarnished everything they touched that could be decent or true. Torture, assassination, lies, cover-up, mass murder, and now the attack against attorneys trying to defend their client and expose government malfeasance and crimes.
It's no coincidence that this news came in the same week as the announcement that DOD was firing U.S. Navy Lt.-Cmdr. William Kuebler from his two-year job defending former teenager and Guantanamo prisoner, Omar Khadr, because Kuebler had spoken out forcefully against the unfairness of the military's tribunal system.
Truly this is a very sick country, with a maniacal ruling elite who loves their technology of destruction, and find nothing sacred in their quest to rule over whatever they want, and whomever stands in their way.
"How can this court have any confidence whatsoever in the United States government to comply with its obligations and to be truthful to the court?"
Your Honor, the answer is "it can't."
Now the question is what are you going to do about it? Something wrong with imposing Rule 11 sanctions or referring any number of colorable ethics violations to the respective bars.
And the bigger question still is what is the legal "profession" going to do about? All lawyers are not created equal apparently--Federal DOJ lawyers get to lie, deceive, and withhold exculpatory "secret" evidence from the defense with impunity or actually "criminalize the defense" of the accused . . . . Will America's lawyers lay down like cowed dogs or stand up like people of principle and honor. Like caretakers of Justice. The lawyers of Pakistan have shown us the way. People will follow if lawyers lead the way.
A whole lot of lawyers livelihoods are on the line here. If people, en masse, lose what little faith they have in the Judicial branch and the legal profession because it can't even maintain the illusion that it produces a pale shadow of "justice", then it's kaput. Self-help becomes a viable alternative. Are we supposed to tell our clients that "yeah there's a great big old system called the system of justice but it's rigged and this is all part of the Kabuki theatre that must take place before they throw you into prison."
So, the faceless Privilege Review Team strikes again, trying to exact revenge for the public exposure of their petty manipulations in which, among other things, they concluded that the commander-in-chief was not entitled to review materials they considered too sensitive. Anyone with information as to the identity of any members of the Privilege Review Team is asked to please be in contact. I am looking for names, and information about the team members’ claims to have graduated from law schools or to have membership in bar associations. They’re long overdue for a privilege review of their own.

I'd like to know who sits on that Privilege Review Team as well. I hope Horton finds out who they are.
Clive Stafford Smith is doing really good work. I'm very impressed that he can remain so calm in the face of the charges that have been filed against him. It's just ludicrous to think that someone in the Pentagon is censoring what can be read by Obama. If they did that to Smith's letter, what else have they kept from Obama?

What makes you think they (the Pentagon) have withheld anything from Obama? This sounds more like Obama has ordered that he not be made privy to this sort of thing.
This incident has been in the news for a while now. If Obama wants to see something from DoD, all he has to do is push the button on his phone and ask to be connected to Gates.
Obama doesn't want to see this shit. If he did, he would.
