It is a sorry day when people cry that the congress should not be expected to do its duty and rein in the power of the executive. Especially when there has hardly been a more egregious example of misuse of the office. Nixon was an angel compared to this Bush/Chaney crowd.

Clearly, the Obama administration is not going to pursue this. To do so would be to take his political agenda off the front pages for the next year at least.

Does not investigation precede prosecution?
Really, all Obama has to do is:
1. Enable Congress to investigate, by smoothing over the Bush roadblocks to congressional oversight;
2. Make sure someone (e.g., Kucinich) indeed investigates.
Then wait for the outcome. I don't see it costing much political capital to do that much. If prosecutable crimes are found, Obama still has the options of (a) not prosecuting and/or (b) issuing pardons.

files charges against any of the alleged Bush criminals, and we have an extradition treaty with that country, wouldn't the US be obligated to extradite?
Presuming that we politically maintain our exceptional nation imagery, and the US can't muster the will to walk the walk, this wouldn't require that anyone named in the charges would actually have to travel to that country filing charges, as Pinochet discovered in Britain vis a vis charges filed in Spain.

Ondelette mentioned Blackwater a while back. They're not being renewed in Iraq. What are their Big Boys -- and Bigger Guns -- gonna do, hunh? 40,000 of them? You know what? That's plenty enough armed insurrectionists to do a real number on the USofA -- even, potentially, to take over the Government. A fraction of that number could theoretically do it.
And that's the risk we all live under, that some rightwing nutbag/would be Christofascist with guns and money, like the Commander of Blackwater, decides to make his play and precipitate... something.
