I'm not sure what you think a truth commission is or what it does. South Africa's TRC was mandated by an act of Parliament, but was independent of it.
The purpose is to find out what happened, to get the facts before the public. TRCs don't have mandates to prosecute. They are generally given the power to issue amnesty to people for speaking the truth... this testimony could be used as part of a future prosecution. Neither the 9/11 Commission nor the Iraq Study Group had this power.
I'm speaking as one who really doesn't see the Holder DoJ aggressively prosecuting the masterminds of U.S. torture and surveillance policy post 9/11. I could - obviously - be completely wrong about this. It's just my read of the political winds.

Prosecuting Bush et al would give them a point around which to rally and galvanize support for their 'persecuted heroes'. Look forward. We have serious problems to deal with, stop being part of the problem and get in to the solutions. Prosecuting Bush NOW is more taking our eye off the ball. In none of your statutes is a time frame referred to, maybe later, but definately definately not now. It is beyond foolish to take prosecutorial action now...it really does not matter, and it is no where near as clear as you try to make it. If it is really so obvious, wouldn't Bush have pardoned the whole crew like his dad did the Iran-Contra crew??
