The gravity of the offense of torture is beyond dispute.

Who would have ever thought that the statement above could come from Mukasey's DOJ?

As for Bush, Cheney, Rumsfeld, Addington, Yoo and Goldsmith, I say give 'em Heck. (Caroline Heck Miller, that is.)

I had thought many times over the past few months how important it would be for the cause of the rule of law if a new heroic figure entered American culture to stand for what is right on these issues. On my recent trip to visit family, we watched together the "Bourne Trilogy" of movies based on Robert Ludlum's "Bourne Identity". Although it is delayed until the very end of the third movie, we see David Webb (the real identity behind Jason Bourne) emerge as the perfect counterbalance to Jack Bauer.

At the end, Webb has the opportunity to put a bullet through the head of the monster pyschologist responsible for the "training" that destroyed Webb's personality and memory (including multiple Cheneyesque "dunks") and turned him into a ruthless killer. Instead, Webb chose to turn over the mountains of evidence he acquired, and the movie ends with arrests and Congressional hearings.

Sadly, in the real world, it's hard to see how that scenario would play out in a world of Ruth Marcuses, Stuart Taylors and Cass Sunsteins.
