  • Thank God for Judge Cotton Matther

  • but it does mean that I don't think that a culture that approves of 18-year-old girls selling their sex is very cherishing of its young women. -- Svensker

Is it possible that a society may find that a thing is "wrong" and should not be done while not using the awesome force of government to put a stop to it? Is it even conceivable that god damn few things should be illegal?

No one should be permitted to use force, coercion, fraud, or intimidation on others. Other than that, he is free to act as long as he hurts no one. If he is negligent and harms another or another's property then he must be made to provide restitution in a civil court of law.

What is so damn hard to understand about finding a thing legal to do in a free land even if one personally would never do such a thing?

If you build a government strong enough to force your fellow citizens to behave as you want them to behave; then that same government will turn on you someday. It is the nature of the beast. (remember the parable in the movie "The crying game")

  • Four Years for Distributing Dirty Movies

Anyone who knows anything about Max Hardcore knows that he's a rapist of sorts who abuses women. And he should probably be in jail for that.

But that's not what he's going to jail for. He's going to jail for OBSCENITY. He could do up to four years for making movies. It's disgusting.

The link below does a fair job of driving the point home. Contains some possibly NSFW ads on the side of the page:

  • @ guygardner

I sort of get it now. Why did they go after him for obscenity and not any other charge? Was it just easier to prove, and is that is why everyone is against it, because it's is a line into stricter porn laws?

  • Freedom and legality

What is so damn hard to understand about finding a thing legal to do in a free land even if one personally would never do such a thing?

I didn't say there should be a law. There shouldn't be.

But just as I think most 18-year-old boys aren't mature enough to decide if they want to enlist in the military and kill people in a war, I don't think most 18-year-old girls are mature enough to understand sexual exploitation and the effects that can have on later life.

Who said anything about making laws?

  • The First Amendment, that's why

Why did they go after him for obscenity and not any other charge?
    — hyblaean

Because pornography is speech protected by the First Amendment. But child pornography and obscenity enjoy no First Amendment protection. So to get a conviction they have to go after obscenity.

    See <http://www.firstamendmentcenter.org/speech/adultent/topic.aspx?topic=pornography>.

  • Who said anything about making laws? -- Svensker

Then we agree totally. My apologies for reading into your position something that was not there.

  • @hyblaean

I've read that it would be extremely hard to actually bust a pornographer of this type with rape or abuse, because the general interpretation is that the girl knows what she's getting into and it gets sketchy since she's being paid.

But I'm not even sure if the feds had anything against this guy because of his demented past. I think they just wanted to bust a high profile pornographer and Max Hardcore is an easy target due to the nature of his films.

The general fear here is that, yes, this conviction is going to start a domino effect with the prosecution of pornographers in the U.S.

(also, I feel kind of creepy trying to come off as "porn expert guy")

  • guygardner

Don't worry about being mistook for porn expert guy. Your screen name has already outed you as a comic book geek. ;)

  • Thanks Guygardner & Frankly, my dear

    http://www.firstamendmentcenter.org/speech/adultent/topic.aspx?topic=pornography

In that link there was this: "The CPPA expanded the definition of child pornography to include “any visual depiction” that “is, or appears to be, of a minor engaging in sexually explicit conduct.” I couldn't make out if that was passed or if it was part of what was struck down in :April 2002, the Court struck down two provisions of the 1996 Child Pornography Prevention Act in Ashcroft v. Free Speech Coalition

If it was a law, could they have gotten him on that rather than obscenity?

Laugh, Guygardener, you are not coming across as a creepy porn expert guy at all. Thank you for helping me understand!

You said: "I've read that it would be extremely hard to actually bust a pornographer of this type with rape or abuse, because the general interpretation is that the girl knows what she's getting into and it gets sketchy since she's being paid." But couldn't they turn this around and say that they men were being paid for being soldiers or spies? And that by participating in that line of work, they were in essence asking for it?

  • I Really Have A Sick Feeling In The Pit Of My Stomach

All very disturbing. You have a woman running for the VP position who is sypposedly a blue-nose, who would burn books and would deny others the right to contraception or abortion, yet she can't persuade her 17 year old daughter to keep her legs together and failing that, to find a partner smart enough to roll on a rubber. We have a government fighting an imaginary war on other cultures. You have the same government inflicting its 'morality' on alternate, less mainstream lifestyles. A government that demands respect and obedience from other nations, yet offers itself like a bitch in heat to Israel. This is all very disturbing. Then there is this torture being done in the name of . . . . ?? C'mon shooter, elephantguy, low-orbitboy . . . in the name of what?? Defendin' democracy? Fightin' fer our freedom? And where do they find the freaks who would do this kind stuff to other human beings?? Are they outsourced? Are they from the private sector? No. These are the folks from next door. Our heroes in uniform. America's best. Oh well, as Rummy used to say, freedom is messy. Stuff happens.
