    But couldn't they turn this around and say that they men were being paid for being soldiers or spies? And that by participating in that line of work, they were in essence asking for it?

    I'm kind of shuddering to think of what you mean by this. Adults acting in pornographic videos isn't really on a par with torture and abuse of prisoners under military control. That the DOJ thinks the former is worthy of extraordinary lengths to prosecute while they themselves sanctioned the latter was I thought the point of Glenn's post, not that there is any strict equivalence between them.

    Nevertheless in answer to another of your questions, about the CPPA of 1996, the parts of the act that were struck down were those that made depictions of sex by minors illegal even in the case that those acting in the depictions were of majority age. The previous anti-child pornography laws, which prohibit exploitation or abuse of minors in the creation of pornography are still very much in effect and people who violate them are aggressively investigated by the FBI and prosecuted.

  • I am curious about what people see as the difference between 18 and 17.

    Leaving the law aside and dealing only with what is right and what is wrong (because morality and laws don't always match), why would it not be okay for ole Max to have girls 16 and 17 in his films since they would more likely match the childlike look he is shooting for. More cellulite after 18, if you know what I mean?

    Would people be cool with that? Should we lower the age at which people can appear in such films to 16? Or maybe 14? Or maybe 12?

    Glenn mentions consenting adults, but a girl who is one day short of 18 is illegal and a girl who is 18 is legal.

    I recently sold my little ranch to an old friend, and bought a beautiful sailboat. Neither of my kids were overwhelmed to be connected to the earth, and since sailing was my first love, I went ahead and divested. The boat I selected is very strong, and fast, built by a world class builder, and could comfortably go to the North pole, or Pago Pago. I can provision for six months at a time, and can be completely self sufficient if I have to.

    I was all for farming, but you just can't do it all by yourself. Well, you could, but this is a lot more fun.

    Is he supposed to be the issue here? I thought Cheney's and W. Bush's torture was the real point. They need to be tried and locked up. Max the Brutal Urine King is a side issue who helps illustrate that real point. Cheney and W. Bush are worse than Max, and they are walking around free and arrogant.

    And we create the laws. And we write the laws to circumscribe acceptable and unacceptable behavior, within constitutional limits. Law codifies social convention and community standards, as evidenced by our reliance on jury oversight. Most communities I know would consider paying someone to let you videotape you beating them and pissing on them abusive and unacceptable. For some reason, you seem to believe that the act of "consenting" puts any and all behavior above the law. That's not a constitutional provision that I'm aware of. You can talk about the freedoms you believe are accorded "consenting adults" all day long, but it comes off as whiny, unless you are able to provide some constitutional backing for your proposition.

    As it happens, philosophically, I agree with your belief in individual freedom, but I don't see our system working that way.

    Yeah, isn't that interesting? It's all a discussion of the girls in the film. Hey, people, at least a couple of the prisoners at Guantanamo being abused were picked up at the age of 15-16. And the government has finally admitted after years of pressure, that there have been female enemy combatant prisoners at Bagram, too.

    But that all pales in comparison to some porn guy. I guess the DOJ had it right, hunh.
