This is a good point. It's why Rockefeller heading the Intelligence Comitte is like some kind of sick joke. But he really wouldn't need to argue that himself. All he needs to do is agree to the hearings, ask whatever lame questions he wants to ask, and then wait for Feingold and Whitehouse to have their opportunities.

OK morons, listen up. Me and Turley are talking about the FISA bill. Is there anything in said FISA bill about warrantless home searches. No.
I'm still looking for the provision that authorizes program warrants (thereby skipping around the established precedence of "warrants apply to individuals"), but once I find it I'm sure it will fit neatly in with these next few bits.
1) There's a section of the FISA Amendments Acts that permits "Concurrent Authorization" (Section 705). What this means is that, once they have authorization to eavesdrop on electronic communications, the Attorney General can target that person without a court order for "foreign intelligence gathering".
2) Parts of FISA (50 USC 1822) define foreign intelligence gathering to include the search of a person's physical property.
So, in theory, once an individual has been the target of the "program" that the FISC approved the warrant for, using Concurrent Authorization, the Attorney General could have your house physically searched without going to FISC.
I've also read that the USA PATRIOT Act amended FISA to permit warrantless searches, but I haven't had time to review.

SEC. 107. AMENDMENTS FOR PHYSICAL SEARCHES.
(b)(2) by amending subsection (e) to read as follows:
‘(e)(1) Notwithstanding any other provision of this title, the Attorney General may authorize the emergency employment of a physical search if the Attorney General--
‘(A) reasonably determines that an emergency situation exists with respect to the employment of a physical search to obtain foreign intelligence information before an order authorizing such physical search can with due diligence be obtained;
‘(B) reasonably determines that the factual basis for issuance of an order under this title to approve such physical search exists;
‘(C) informs, either personally or through a designee, a judge of the Foreign Intelligence Surveillance Court at the time of such authorization that the decision has been made to employ an emergency physical search; and
‘(D) makes an application in accordance with this title to a judge of the Foreign Intelligence Surveillance Court as soon as practicable, but not more than 7 days after the Attorney General authorizes such physical search.
