The only problem here is that the program was started in February 2001, seven month before 9/11. Horton could have cut her off at the knees but his lack of knowledge here simply let her off the hook.

The interview you're quoting is from Warren Olney's radio interview of Jane Harman, not Scott Horton's magazine interview of Jane Mayer.

More importantly, the assertion that the program started prior to 9/11 is just that -- an assertion, with no proof. Joseph Nacchio, as part of his criminal trial, alleged that the Government approached Qwest about some form of warrantless eavesdropping prior to 9/11, though we don't know (a) what that was, (b) whether it happened or (c) if it's true.

The fact that the telecoms and Bush officials were perfectly happy -- from the start -- to have telecom immunity apply only to post-9/11 but not pre-9/11 spying leads me to believe that most of the illegal behavior was after 9/11 (which isn't the same as saying it was motivated by 9/11). We'll see since, as I said, the immunity only applies to post-9/11 spying.

Naming Names...

Kitt... You think you've got troubles; when your screen name is "Cocktailhag," those trolls have a field day. (OK, in this case miniature golf course, but you know what I mean...) Whether it's ageism, "Hag," puritanism, "put down that drink," or Lord knows what, the slings and arrows make me wonder whether the nice saint's name my mother gave me wouldn't have been a better idea.

But at the same time, as you've said, anyone who goes after your name rather than your argument probably has one foot on a banana peel, logically. I've noticed that you have no trouble laying the offender to waste when that happens.

As usual, the double standard can always be employed.... Names are for those who deserve them.

The lies in our warrant had to do with stolen baby clothes (believe it or not).

I appreciate your reply.

To my knowledge there are only two reasons for a no knock warrant, they either think you are armed and likely to resist violently or you are going to flush "drugs" down the toilet in order to dispose of evidence. I fail to see how either motivation could apply in the case of stolen baby clothes.

It would be interesting to me, and I suspect to at least a few others as well, to learn a bit more of just what happened, it sounds seriously bizarre to say the least.

If it would be disturbing to you to relate further please feel free to ignore me.

Slight oversight by Scott Horton

In the Article Mr Horton asks a question of Jane Harmon regarding Quests refusal to go along with the illegal request to have access to all internet and phone traffic. Harmons answer was:

HARMAN: Well, I respect what Qwest did. Qwest said that the strict letter of FISA isn't being followed, as I understand it. That was some very careful lawyering.

The other telecoms that complied with requests believed -- so they say -- that they were complying with valid requests from the Government. And remember that when this happened, it was shortly after 9/11 and so forth --

As you may know, I have been fighting the FISA “compromise” ever since it was dreamed up by Jay Rockefeller, Chair of the Senate Intelligence Committee. Unfortunately, it appears that you have drunk the “Kool-Aid” that Rockefeller has been drinking ever since he was included in the secret briefings that the Bush Administration held shortly after 9-11. Key Democrats, including current House Speaker Nancy Pelosi, Former Senate Majority Leader Tom Daschle, former ranking House Intelligence Committee member Jane Harman, and several others were extensively briefed on both the illegal wiretapping and NSA data-mining programs, as well as the illegal torture-rendering that was going on at Guantanamo. While they did not actively formulate and create these illegal activities, since they were advised of them, they are at least complicit co-conspirators.

As far as I know, one of the weights behind the Obama candidacy is Daschle.
