Isn't this unconstitutional?

Since this section clearly states that it affects conduct prior to January 2007, isn't this an ex post facto law, and therefore unconstitutional?

I still fail to see why any reasonable person (e.g., one not receiving large cash payments for one's reelection campaign) would think this is a good idea. If we believe that our courts dispense justice, then either the activities of the telecoms was legal -- in which case they have nothing to fear -- or not -- in which case they rightly have everything to fear.

All of this is depressing,

but none of it would cause me to vote for anyone other than Obama. There are too many other factors that would become greater disasters if a Republican were to retain the Presidency. And all of this being said without knowing for sure yet where Obama will fall on this bill in the next 24 hours.

We were originally talking about going after some of the vulnerable Blue Dogs in Congress, however, and I believe that's an idea with merit. FISA is being passed by people who, I assume, believe there's no political fallout from their vote (nowhere else for us to go) and that's probably a good calculation unless we can get to a position with leverage.

So a no brainer: I made a donation. You want to argue how many or how few Blue Dogs to target before we are in danger of tipping the balance, fine, no problem, but I don't see any value in doing absolutely nothing out of fear. Fear is what got us here.

I'm done

I hate to say it, but Ralph Nader was right: there is no difference between the parties. We need to get all the clowns out of power and start over. As long as there are incumbents and lobbyists, nothing is going to change. I'm so mad! I want to take my country back, but don't see how. It just will not happen at the ballot box. The game is rigged. I'm just tired of protests and ad campaigns and 'call your representative.' To hell with it.

This is just another example of how we have so easily given up our ideals in the name of 'security.' Bin Laden has won, and we did all the hard work for him.

Sorry, Rufus, but with all due respect, THIS is where Obama needs to stand up and be the leader we all want him to be and kill this bill dead in the Senate. It will be TOO LATE for him to do a damn thing about it if/when he takes office. What he's going to do, push through reverse legislation? Good luck with that. The GOP aren't pussies like the Dems. They'll kill any reversal, because they're not douche bags, like the douche bag Dems.

Obama wants to represent the change we want. We can't do this. He can.
