Congress is going to decree that the president has the power to order private citizens to break the law, as well as to spy on our telephone calls and e-mails with no warrants.

I know how you feel. Out of respect for Glenn and all he does, please don't vote for McCain. That would make him very sad.

Again, who said anything about voting for McCain? I will vote "other", almost picking at random some other name on the ballot.

Here's the deal, both me and my wife have been debating NOT voting this year (for the first time EVER) or, in my case, voting anti-Democrap. This bill makes my decision easy: anti-Democrap voting.

If Not Now, When?

When Senator Obama is president, there will be no more illegal wire-tapping of American citizens; no more national security letters to spy on citizens who are not suspected of a crime; no more tracking citizens who do nothing more than protest a misguided war. Our Constitution works, and so does the FISA court. By working with Congress and respecting our courts, Senator Obama will provide our intelligence and law enforcement agencies with the tools they need to track and take out the terrorists without undermining our Constitution and our freedom.

There will be this and there will be that, all when Obama becomes President. Very nice, I'm sure, but what is he going to do NOW?

I am so angry I'm probably going to be fired for spending all day reading Glenn's blog and writing emails to various congresscritters (read: rats).

Question

Glenn and others,

I do not have the law in front of me, but as I remember it, under the old FISA a corporation could cooperate with federal law enforcement officials under the protection of immunity if the request was made (1) pursuant to a federal court order, or (2) was accompanied by a certificate of the Attorney General giving his or her opinion that the action was legal.

Under the proposed “compromise,” it appears that the certificate from the AG has been fundamentally changed. No longer does the AG have to give an opinion that the action is legal. Now the AG need merely certify that it has been “determined to be legal” (presumably by the President? Vice President?)

Don’t we surmise that the flap in John Ashcroft’s hospital room between Jim Comey and Alberto Gonzales (with Andy Card in tow) was over Ashcroft’s and Comey’s unwillingness to conclude themselves that some surveillance action was legal? Under the new law, won’t some future Gonzales be able to force the issue by saying “You don’t have to certify that the action is legal. You just have to certify that the President thinks it is legal. And he (or she) does.)?

Called my Rep

I just called my Rep. John Yarmuth to find out if he was still against telecom immunity. His office would not tell me. The man answering the phone in Wash. wanted to get my address so they could mail me a form letter. I told him the vote was tomorrow and that my address wouldn't do either of us much good. I then called the local office and spoke with a woman who also told me that she couldn't say how he was going to vote because they didn't know what would be in the bill. I told her that what we read online was not good.

Now I'm getting nervous. Yarmuth voted against telecom immunity the last time.

That was very good. I laughed.

I'm not sure he's going to do anything on this. Caution being the better part of valor and all...

But he is looking better and better every day.

Some of you kids have a problem when looking at the electoral map.

Yeah out of how many total votes? Answer that. I am guessing you won't though because isn't that 130 out of over a thousand of votes he could have participated in? Doesn't that 130 number represent something like 10% of the total votes? IIRC that is exactly the case. You Clinton trolls are exposed by your talking points.
