Obama, telecoms and the Beltway system

Why is the Democratic nominee intervening in a Democratic primary to support one of the worst pro-war, Bush-enabling Blue Dogs against a highly credible, progressive challenger?

Steny Hoyer is a Democrat

I was just assured that, contrary to what is being "reported" on FOX, Steny Hoyer is a Democrat and he intends to remain a Democrat.

The person answering the Majority Leader's phone was clearly incredulous that FOX would "report" that he was going to switch parties and that the report would be believed merely because "he's voting as a Republican".

BTW, while I was talking to the Majority Leader's office, I was placed on a short hold which would seem to indicate that Hoyer's phone lines are just a tad busy.

Here's the language, if I'm not mistaken

Page 14:

16 ‘‘(h) DIRECTIVES AND JUDICIAL REVIEW OF DIREC

17 TIVES.—

18 ‘‘(1) AUTHORITY.—With respect to an acquisi

19 tion authorized under subsection (a), the Attorney

20 General and the Director of National Intelligence

21 may direct, in writing, an electronic communication

22 service provider to—

23 ‘‘(A) immediately provide the Government

24 with all information, facilities, or assistance

25 necessary to accomplish the acquisition in a

1 manner that will protect the secrecy of the ac

2 quisition and produce a minimum of inter

3 ference with the services that such electronic

4 communication service provider is providing to

5 the target of the acquisition; and

6 ‘‘(B) maintain under security procedures

7 approved by the Attorney General and the Di

8 rector of National Intelligence any records con9

cerning the acquisition or the aid furnished that

10 such electronic communication service provider

11 wishes to maintain.

12 ‘‘(2) COMPENSATION.—The Government shall

13 compensate, at the prevailing rate, an electronic

14 communication service provider for providing infor

15 mation, facilities, or assistance in accordance with a

16 directive issued pursuant to paragraph (1).

17 ‘‘(3) RELEASE FROM LIABILITY.—No cause of

18 action shall lie in any court against any electronic

19 communication service provider for providing any in

20 formation, facilities, or assistance in accordance with

21 a directive issued pursuant to paragraph (1).

So a warrant is plainly not needed at all---only a letter from the Leader's bureaucracy. Further, a carrier actually faces contempt if it refuses an order without petition.

And the telecoms PROPOSED this.

Thank you Glenn for taking Obama to task. I have to admit that i have often been one of the critics painting Obama with the broad brush of cynicism--I have to say, however, that my experiences here in the past few days have altered my view of the political process somewhat. I have never seen anything like this very focused and IMMEDIATE movement, with such an incredible impact. I am comign to the perspective now that politicians are all--whether corrupt or golden hearted--subject to a great tangle of obligations, the least ranking of which is to the constituency that elected them. In this case, they, like anyone, need to be reminded what's at stake for ignoring political realities. One of my pet peeves have been those who have apologized at every step for his behavior, but I and others have also, perhaps, been too uneccesarily critical, if only to remind our friends and such that we are not suckers. What's the point of that? And finally, perhaps the amnesty provision is a compromise. At least it has an end-date (sarcasm).

On another note, I was hoping someone could explain the suit issue. Someone opined yesterday that the suits come in to play only after it has been determined by a federal court that the telecoms have indeed broken the law. Is that more or less the way it works. Time for all you know-it-alls to do your thing.
