Mukasey should be disbarred--
Waterboarding is defined in the laws banning torture as being torture. And it has been banned as being that since at latest the 1949 Geneva Conventions as an outcome of WW II, during which the Japanese (and likely Nazis) used it on POWs.
The internatioanl treaties which prohibit torture, and waterboarding, to which the US is signatory are part of the "law of the land". the "law of the land" is the Contitution. Neither Congress, not the Executive, nor even both together with the approval of the Judiciary, can change the Constitution. The fig-leaf--and _ex post facto_--statutes enacted by the Republican Congress in effort to cover up and protect the war criminals who comprise the Buhsit criminal enterprise are flatly unconstitutional and null-and-void--as well knows such as lawyer/JAG Lindsey Graham; and yet he supported them, against the rule of law upon which our country is founded.
Mukasey should not only not be approved; he should be disbarred for making of the law a political football; for substituting politics and ideology for the rule of law. For essentially promising both to not prosecute the war criminals, but also to perpetuate those crimes, and make of himself an accessory thereto, by approving them, exactly as his hack predecessor, Gonzales, did.
It is the responsibility of those who take the oath to uphold the laws, when it is their role to do so, to not only accurately state the law as it is, but also to prosecute violations of it--not instead to join the fraternity of criminals while pretending to be law-abiding. By refusing to state the law on the matter--waterboarding is unequivocally torture, therefore absolutely prohibited--Mukasey has declared himself to be an enemy of his country, a traitor joining the war against the system of laws termed "The United States of America," and as constituted in the Constitution.
Indeed, it is a wonder that he has been perceived, up to now, as competent to practice law, and to objectively judge it, when he has all along been a political ideologue masquerading as objective and upstanding.
