    There IS NO stataute of limitations for desertion. BTW, here it is in the UCMJ for your viewing pleasure. Oh BUT one must PROVE desertion in a military court of law...so you may have a problem with that one.

    Uniform Code of Military Justice (UCMJ)

    ART. 85. DESERTION

    (a) Any member of the armed forces who--

    (1) without authority goes or remains absent from his unit, organization, or place of duty with intent to remain away therefrom permanently;

    (2) quits his unit, organization, or place of duty with intent to avoid hazardous duty or to shirk important service; or

    (3) without being regularly separated from one of the armed forces enlists or accepts an appointment in the same or another on of the armed forces without fully disclosing the fact that he has not been regularly separated, or enters any foreign armed service except when authorized by the United States;

    is guilty of desertion.

    (b) Any commissioned officer of the armed forces who, after tender of his resignation and before notice of its acceptance, quits his post or proper duties without leave and with intent to remain away therefrom permanently is guilty of desertion.

    (c) Any person found guilty of desertion or attempt to desert shall be punished, if the offense is committed in time of war, by death or such other punishment as a court-martial may direct, but if the desertion or attempt to desert occurs at any other time, by such punishment, other than death, as a court-martial may direct.

    So the War President was drunk and pissing on cars when he was a War Lieutenant.Hmmm! I hope Mr.Rather takes this suit to the limit,not for the money which I think he feels is irrelevant,but to once and for all time expose our War President for the MADE-UP PHONY that he really is!!!!!

    It would be very interesting to find out if there is a statute of limitation for desertion during a time of war. If there isn't and Bush has to face a trial for desertion, he will have to provide proof that he had actually served out his term in the Guard, and for all we know, that proof doesn't exist.

  • The problem is

    - main stream media is already discrediting Dan's case against CBS. I've already heard an NPR report deriding him for his lawsuit, making it sound like he is some egotistical crackpot who doesn't have a legal leg to stand on. Because of that NPR report, I approached this article with some skepticism. After reading it I'm left with is uneasy sense that no matter what happens with this case, the right will not allow the media to focus on the core issue - was Dan's report on Bush's National Guard record accurate? Instead we are going to get a lot of conservative spin and funny e-mail photos of Dan from our Republican friends and family. It has long been a dilemma that perception is stronger than truth and every day it becomes more and more apparent.

    Thank you Salon for not giving up and still trying to focus what really matters.

    BTW anonymous, if YOU ever say in public that it's no big whoop that Bush blew off military service so he could party the 70s away but 30 years later he could nonchalantly send American troops to their deaths for nothing but LIES, you'd better make sure none of the families of those dead soldiers are within earshot. If they are, maybe they'll go all Abu Ghraib on you. And while you're standing on a milk crate with a burlap sack over your head having your testicles electrocuted you'll have time to rethink your position on whether Bush is guilty of war crimes.

The sissy Sidney Blumenthal, like his boss Bill Clinton, was a draft dodger during Vietnam and Dan Rather could not hack Marine Corps boot camp.   • Should be slam-dunk for Rather

    Seriously, this ought to be a slam-dunk case for Rather if he does it right, gets the right legal help with am emphasis on competence. The reason is that the BBC already blew the cover off the Bush dogging with the AL National Guard more than two years ago.

    All Dan really has to do is go there for vindication and all the resources he requires. It was obvious from the get go that Viacom execs wanted to cover their butt and do a pre-emptive hit on the story to avoid retaliation from the Corleone-imitative Bushies.

    For all those people saying that this is about Dan Rather's ego, I think you are wrong. It takes a lot of guts to sue CBS. They are a huge corporation with a lot of power. And I do believe Rather when he says that the lawsuit is not about his career and this particular story. This is about the media and what a joke it is right now in this country. Reporters don't question anything this administration does. If they had, we would not be in Iraq right now. The reason has to be because the higher ups are burying stories that would be unfavorable to Bush. I saw Rather on Larry King and I think he was genuinely concerned for the country and the direction it is headed. The MSM has to take a lot of blame for this. I support Rather 100%! At least someone has the guts to go up against Bush.
