I think I can answer that for you. O'Reilly's noxious statements are protected by the First Amendment. In order to criminalize speech that arguably advocates unlawful activity, the speech has to be a direct incitement to imminent lawless action. The key words are "direct" and "imminent," and you don't have that here. The Courts also give even wider protection to speech on controversial issues of great importance to the public (on both sides of the issue). O'Reilly has been very clever in avoiding telling anyone to do anything other than protest.

O'reilly put Tiller in the public eye???? Anyone who lives in this city knows this is not true and is a slam on O'Reilly. What was done was wrong, and my hope is that the guy who killed Tiller get's the full penalty of the law, but let's be honest about the facts of this case. Tiller was one of only 3 docs in the country that did this type of abortion. He was well known in Kansas and the nation long before O'Reilly pointed him out. Let's see, we condemn a man who stands up for the rights of unborn children, including late term sustainable fetuses. And we support a man who has committed over 60,000 late term abortions.
