    Investigating Bush

    Congress can investigate whomever it wants, but I can't believe Obama will have much of an appetite to spearhead an investigation of the Bush administration. We are still at war in Iraq and Afghanistan, and I doubt Obama, as the new commander in chief, will want to take legal positions in any investigation regarding various detention policies or interrogation techniques. Doing might have the result of eroding his own executive authority in prosecuting the war and doing what is necessary to protect our troops. Also, if he gets behind an investigation alleging widespread criminal conduct on the part of the Bush administration, he might find himself the target of such an investigation when he leaves office.
