Would Obama prosecute the Bush administration for torture?

Obama's brain trust wants to form a commission on torture and call Bush officials as witnesses, but put off prosecutions -- if any -- till a second term.

    I'm sure that's what will happen.

    And I'm equally sure Obama will echo Gerald Ford (instead of showing us something new!) and let the past stay in the past.

    Which will suck rocks.

    But, as a hypothetical, if people have been pardoned, can there still be an investigation? You know, for the history books?
