    "Why don't we have a national ban on smoking in public?"

    Because the Federal government has no authority to regulate that behavior. Is Devra Davis so ignorant of the notion of Federalism? Does Ms. Davis envision an army of Federal agents stationed on every streetcorner, authorized to arrest and punish everyone who lights up a cigarette or spits on the sidewalk? Maybe that's the kind of society some people want. Not me.
