Hmmm... you raise a very interesting legal question. That is technically sound, yet very very hard to prove or disprove either way.

The second scenario you described, where the attacker kills the fetus(hereafter referred to as Minor) and is killed in turn by the mother(hereafter referred to as Caretaker).

Now, as a lawyer [for the poor mother], i can argue that the Minor was in no position to defend himself because:

a) He is a minor.

b) He is in a secured location, such location being provided by the Caretaker with a reasonable guarantee against harm.

As a Caretaker, she did NOT know, to the best of her knowledge, that the Minor under her care has died. Since she did not know at that time, she was justified in using deadly force to kill the attacker who threatened to harm the Minor in her care.

As the lawyer for the attacker, i can argue:

The Caretaker deliberately wanted to commit premeditated murder of the attacker by using the law as a shield to defend herself from prosecution by:

i) The Caretaker was willing to sacrifice the life of a minor in her care to commit murder allowed under law as a self-defense.

ii) The Caretaker had reasonable expectation and knowledge that a knife WILL kill the Minor in her charge, having used knives herself to gut fish (am just guessing here).

iii) Knowing that the knife thrust was meant for her, but wanting to escape, the Caretaker exposed the Minor to a deadly situation where the Minor was unable to move away from harm or defend himself. This fact was previously known to the Caretaker before she deflected the knife thrust against her to her stomach.

So as a defense lawyer for the accused/dead, i can state that this was a case of premeditated murder committed under the cloak of a law that was meant to protect innocent.

I would say Obama is a Charmer: He charms his way into the world.

His actions, interviews, statements, visits are calculated to charm the whole world except USA.

When it comes to dealing with the problems of the country he has sworn to protect and defend, he is just like Bush: careless, carefree, unapologetic, and defends EVERYTHING under state secrets.

4) Continues to refuse to issue a presidential decree ordering large banks to start lending while threatening GM and Chrysler to declare bankruptcy.

5) Refused to issue a time table of pulling out of Iraq while stonewalling attempts by EFF and ACLU to find the true status.

6) Refuses to order the AG to file cases against corrupt bankers and AIG officials inspite of overwhelming proof against them.

Bush was hated. Agreed. But he did NOT lie to the face of the public. Yes, he refused to lift a finger to help Katrina victims and refused to listen to the public about Iraq. But he was honest about it. He faced the public and showed his middle finger to them bravely. Yes, that was an abhorrent gesture, but atleast you got to respect his honesty.
