During the Nuremberg Trials, the head of Ministry of Justice of the Third Reich Judge Ernst Janning was charged with war crimes.

His defendant, Rolfe argued brilliants with several points:

1) A Judge applies the laws, he does not make them.

2) If janning were to resign like others, then someone worse would take his place.

3) The theories of Racial discrimination and putting to death "genetically indisposed" people was pioneered by the US Supreme Court justice and the Virginia Supreme Court and not by the Reich. The law stated that mentally retarded and genetically poor people needed to be sterilized. The Judge applied the law and did not convict a man for his political beliefs.

4) The needs of the many outweigh the needs of a few racial minorities.

5) The legalized killing of a few hundreds racial minorities to provide peace for millions more is justified.

Judge Haywood brushed aside all these arguments and stated that Ernst Janning became tainted and a war criminal with the first sentencing of the man he knew to be Innocent, irrespective of what the law stated.

Judge haywood was immense pressure to free the men because USA needed the support of Germans politically.

The same arguments that Rolfe used to defend Ernst Janning (however good he may be) is used by these criminals.

And i hope that American Justice and another Haywood discards all these arguments, vigorously defends the law and Geneva Convention and stems the rot of the Bush administration.

Finding these men guilty and sentencing them to life however high they are (Rumsfeld or Cheney) would set a precedent that America respects the law.

Failure to do that would show America as a country considers only American Citizens as human beings and the rest as Untermenchen: The same that Hitler claimed 70 years ago.

Like corporations, Legislators too should be evaluated 360 degrees.

Legislators make the law that citizens have to obey. Citizens have no direct saying on the law that the legislators choose to pass.

To prevent legislators from exempting themselves from obeying such laws, the constitution should be amended to allow citizens to evaluate the validity of each vote of their legislator.

Any vote or act by a legislator like submitting a bill or voting on a bill should be approved by the majority of the voters.

If not approved, the legislator's vote is held to be invalid.
