"The barriers to these prosecutions are numerous",

including our own Legal Class. Why is this just firmly rested, to use DC LAWS words, at the feet of our political class? Where is the profession you belong to Glenn? Where the hell are they in their collective wisdom and their outrage? Well?

Is the Justice department not bound by any ethical standards that can be upheld by the Bar? Is this going to die on the vine because of the absolute power of the Legislative branch? So much for co- equal huh? Don't get me wrong but, you, John Turley, and Scott Horton seemed to be a little outnumbered here.

Seriously, The Military trumps the Judiciary on this one..

So your telling me a Judge can't be trusted with Intel, but the Military and the CIA can? How convenient, The Unitary Executive and a few slavish appointees along with a few Star Chamber Senators on the Judiciary Committee now can cut Federal Judges out of the loop. How novel and quaint. Will someone please tell me why the legal profession isn't up in arms about this usurpation of power. It's the equivalent of a Unitary Junta. The judiciary, what a joke.

"Nothing is more mysterious...

than a fact clearly stated." Lisette Model

I think this is where it all ends. Obama released the facts from being obstructed and any reasonable person, specifically members of Congress, who supported the retroactive immunity for the telecoms can respect the unfortunate but necessary steps that were taken to safe guard the American people. dead in the water folks. the retroactive immunity was the major component to justifying the nasty things we have to do as a government and the administration of those ends are outside the reach of the rule of law. Seems pretty simple to me.

Hayden works for the Chertoff Group. Another fact clearly stated.

Went down to the Crossroads, got down on my knees....

I can't wait until we get an inside view one day on just how badly misused the NSLs were applied in the name of National Security as well. This is going to be a long painful road for those of us who have paid attention and actually care. I think another big mistake on top of the retroactive immunity bill was Congress not insisting that the oil execs take an oath before testifying. That was an instant mockery of the respect for the rule of law and wreaked of preference for the elite and our excepted class. Glenn you should have about 3-4 books out by next year, right?

@ paradox_left_coaster

Great question. The legal class is a form of energy at rest. They are useless without a catalyst, namely a client. It's apparent that there are very few who actually feel the need to defend the structure of their own existence, that being the rule of law. We should view them as attack dogs on a leash and given the right reward do our bidding and navigate us to our own ends as self interest demands. To expect that they would have any other role is foolish. Ya pay yer nickel you take yer chances....

That's what friends are for...

Public Image Limited:

Promises, promises

Old tired, worn out second hand sentences

One thing, with you is certain

You’re a really sad person. So sad.

CHORUS

Disappointed a few people

When friendship reared its ugly head

Disappointed a few people

Well, isn't that what friends are for?

What are friends for?

You, you're just a really bad person

Who won't, you won't, listen to anyone. No not you

With those half moon eyelids

Just babbling on, your useless defences. So sad.

CHORUS

This erratic haphazard, fluttering

This to-ing and fro-ing

Like a confused moth

The collusion, illusion

And it's all ad infinitum

You're a really sad person. You're really so sad

CHORUS

Fools and horses

Running their courses

And brow beaten down

Like dust on the ground

You cheat easily

Like sweet charity

And all of the bastards

The world despises

Springing surprises

In newer disguises

You cheat easily

Like all charity

This is what we have been sold from our government.

Is "ugly" the new word for Treason?

The euphemisms generated by our ruling class to protect themselves from the law, when the actually respect its grasp, just crack me up.

To Paraphrase Don Rumsfeld..

As you know, you go to war with the "LAW" you have. They're not the "LAWS" you might want or wish to have at a later time." I think even though the legal footing for this is remarkably questionable this will get shrugged off and stonewalled into a weasel clause festival. My hopes are right above whale shit right now for expecting any criminal charges against ANYONE. I would point to a recent comment here pointing out the fact that MIchael Scheuer mentioned that Clinton was the one who set up the rendition program, does Holder the "Independent" want to go that far down the trail? I'm not saying I wouldn't be happy with a good investigation I just don't think the probability of one occurring are anything but zero.

Two Points..

First, this quote:' Most people around the world do not accept the overarching belief of our political class that America can and should be exempted from the laws and standards imposed on everyone else."

I will complete it with; and will have absolutely no recourse what so ever when the perpetrators of these crimes are not held to account, for either the crimes they committed or those blatant pedantic hypocritical double standards they espouse for the rest of the world.

Second: The waters have been tested and the retroactive immunity bill for the deeds of the telecoms and the administration that facilitated their actions was just a primer for this scenario. I assume that Congress will generate another blackmail bill of that kind very soon, and initiate similar immunity for the participants. This will cost the President major support from his own party, but the alternative will be deemed too catastrophic to our nation's current feeble condition.

Exceptional class wins and they will prove it here very shortly.
