    Do these folks not think for one minute to consider the possibility that someone like Russ Feingold could become President, sorry about the projection on Sen. Feingold, and Padilla them off to the Brig in South Carolina for crimes against the Republic? Is it in such contrast that we are able to determine exactly who has done more real harm and presented a threat to the safety of our citizenry and our republic either Mr. Yoo and his followers or Jose Padilla? Seems kinda grey to me on that one. I also find it interesting that Mr. Yoo didn't bring up the distinction some right-wing folks make between Mr. Clinton and the current white House, namely Mr. Clinton lied about information not related to his duties as President. Is that all they're holding on to is the declaration of War scheme?

    The only reason I have read that makes sense for the votes in the affirmative by both Mr. Webb and Mrs. Mikulski is that the NSA employs way too many residents of each of their states and receives boatloads of federal funding. I hope the Senator from Maryland will consider the damage she has done to her reputation and future political career. Though I'm sure she find a nice cozy job with Booz Allen Hamilton waiting for her after she finishes in the Senate.

    But that theory of the Executive unconstrained by law is completely repulsive to the founding principles of the country, as well as to the promises made by the Founders in order to extract consent from a monarchy-fearing public to the creation of executive power vested in a single individual. The notion that all of that can be just whimsically tossed aside whenever the nation experiences external threats is as contrary to the country’s founding principles as it is dangerous.

    Great appearance as usual this am on WJ. I loved how MR. Rivkin, made his first 2 suppositions to explain his views by referring to you as, in the first one, a terrorist and the second as a Mafia Don.. Your points about the track record of the Bush administrations' regarding history of questionable trust and the fact that Sr. Justice dept. officials were ready to resign en-masse were dead on. Thanks for your time. and energy.

    I've been reading the actual bill, thanks for the link to MM, they post it as a pdf, and this line struck me .. Sec 2 "

    ‘(f) The Government shall compensate, at the prevailing rate,

    a person for providing information, facilities, or assistance pursuant

    to subsection (e).

    I know I've brought this up before but let me restate it.

    It sure strikes me as curious that the day after the new law is enacted an Intel committee member offers an amendment to bury the budget for the bill they just passed, which also compells the release of the budget info. What the hell is the prevailing rate? if we can't find out what a provider, say Booz, Allen, Hamilton, charges how can the public know what's prevailing, let alone equitable. Wasn't Director McConnell a senior VP who made boatloads of money working for them? Again the trust us mentality takes front and center.You know, like the CIA billing the public for Hookers and Limos,or Halliburton being the only service provider available, that kinda thing. The amendment is up for review, we'll see how it goes.

    Capitulation will never get to 1%. The Neoconservatives cannot allow any defeat to be measured or ever recorded, especially without their creative revisionism. You have brought some critical examination to their functioning exercises. If everything shy of complete devastating victory is untenable then they should stop at nothing to continue their perverse usurpation of the congress and the judiciary. Your attention to this matter is commendable.

    Do we not give Billions in aid and promises of military support to the same countries that produce those very same radical Islamists that the right wing screech festivals are squealing about? What's it to them anyway, don't they all believe Tim Lehay's books? Apron, burka what's the difference to these Ward Cleavers anyway?

    I think all along Iran was on the chopping block and Iraq was just an oil rich base camp with shattered people ready to treat us as Liberators. I can't help but think that this game has been on since day one and Iraq got complicated and apparently Richard Cheney and his crew could really care less. If you were going to try to destroy as many power bases in the Middle East where would YOU start? As Glenn's book has described so well, the Manichean mindset sees little value in scarce resources or details, just the biggest of Big pictures. Domestically, Dick Cheney is channeling John Adams and apparently it's working.

    OTBR, off topic but relative, If the telecoms are trying to get off the hook is this related to criminal charges? Is it me or could a fifth grader figure out that if the Telecoms are trying to be forgiven for breaking laws at the request of the President, doesn't that kinda implicate the President?
