You are incorrect. Children are presumed to be placed with the primary caregiver, regardless of parental fitness - the "tender years" doctrine holds in CA, despite attempts to prevent this bias.

There is no presumptive, rebuttable joint custody legislation in CA that gives both parents equal footing in front of a judge. In addition, if one parent (usually the mom) has >70% custody, then she can leave the state or country without notifying the father.

Hopefully the "mother and siblings" won't be punished. After all, they are likely mentally ill (post partum depression, PMDD?) and need help, not jail terms.
