Congressional cowardice at its finest

Here are the salient excerpts of what just passed in the House, 253-168:

H.R.6166 Military Commissions Act of 2006 (Introduced in House)

SEC. 5. TREATY OBLIGATIONS NOT ESTABLISHING GROUNDS FOR CERTAIN CLAIMS.

(a) In General- No person may invoke the Geneva Conventions or any protocols thereto in any habeas corpus or other civil action or proceeding to which the United States, or a current or former officer, employee, member of the Armed Forces, or other agent of the United States is a party as a source of rights in any court of the United States or its States or territories.

SEC. 6. IMPLEMENTATION OF TREATY OBLIGATIONS.

(a) Implementation of Treaty Obligations-

(3) INTERPRETATION BY THE PRESIDENT-

(A) As provided by the Constitution and by this section, the President has the authority for the United States to interpret the meaning and application of the Geneva Conventions and to promulgate higher standards and administrative regulations for violations of treaty obligations which are not grave breaches of the Geneva Conventions.

SEC. 7. HABEAS CORPUS MATTERS.

(a) In General- Section 2241 of title 28, United States Code, is amended by striking both the subsection (e) added by section 1005(e)(1) of Public Law 109-148 (119 Stat. 2742) and the subsection (e) added by added by section 1405(e)(1) of Public Law 109-163 (119 Stat. 3477) and inserting the following new subsection (e):

`(e)(1) No court, justice, or judge shall have jurisdiction to hear or consider an application for a writ of habeas corpus filed by or on behalf of an alien detained by the United States who has been determined by the United States to have been properly detained as an enemy combatant or is awaiting such determination.

`(2) Except as provided in paragraphs (2) and (3) of section 1005(e) of the Detainee Treatment Act of 2005 (10 U.S.C. 801 note), no court, justice, or judge shall have jurisdiction to hear or consider any other action against the United States or its agents relating to any aspect of the detention, transfer, treatment, trial, or conditions of confinement of an alien who is or was detained by the United States and has been determined by the United States to have been properly detained as an enemy combatant or is awaiting such determination.'.

(b) Effective Date- The amendment made by subsection (a) shall take effect on the date of the enactment of this Act, and shall apply to all cases, without exception, pending on or after the date of the enactment of this Act which relate to any aspect of the detention, transfer, treatment, trial, or conditions of detention of an alien detained by the United States since September 11, 2001.

Despicable. Bush got everything he wanted; [1] the power to interprete Geneva, [2] no habeas corpus or petitioning against detention via Geneva, and [3] retroactive CYA indemnity. The Senate is expected to pass similar language tomorrow.

Article III, Section 2 of our Constitution gives the Supreme Court the final say in interpreting the extent of binding provisions of ALL treaties. Consequently, this bill is patently unconstitutional on that count alone. They can pass whatever they want. Doesn't make it Constitutional. But, Bush is now one Supreme Court vote shy of truly becoming King George.

A sad day for our nation.

QUARRYVILLE, Pa. (Fox News) - When the deputy coroner (R-Pa) reached the Amish schoolhouse, she found blood on every desk, every window broken and the body of a young girl (R-Pa) slumped beneath the chalkboard. Ten (R-Pa) children had been shot, five fatally, and the gunman (D-Pa) was dead.

“It was horrible. I don’t know how else to explain it,” Amanda Shelley (R-Pa), deputy Lancaster County coroner, said Wednesday. “I hope to never see anything like that again in my life.”…

Authorities say Charles Carl Roberts IV (D-Pa) had started buying supplies for a long siege six days before he stormed the tiny schoolhouse. He made a checklist of what to bring and wrote out four suicide notes, one talking about how he (D-Pa) was “filled with so much hate” and “unimaginable emptiness.”…

Roberts (D-Pa) had brought lubricating jelly to the schoolhouse and may have planned to sexually assault the (R-Pa) Amish girls, State Police Commissioner Jeffrey B. Miller (R-Pa) said. He said a piece of lumber found in the school had 10 large eyebolts spaced about 10 inches apart, suggesting that Roberts (D-Pa) may have planned to truss up the girls…

IN OTHER NEWS:

Mark Foley (D-FL), according to his lawyer, "takes full responsibility" for his (D-FL) immoral acts. Oh, and BTW, he (D-FL) was abused by a priest as an adolescent (cue weepy music) and is gay (D-FL) and an alcoholic (D-FL). But, none of those (D-FL) characteristics have any bearing on his current (D-FL) "off-safely-to-rehab-sanctuary" problem, wink, wink.

I just watched Bush's latest Pissy Presser. He needs to hire a new lyricist, preferably one with a pulse. Essential summation follows for those who missed it:

Elections rigged?

Maybe it's tinfoil hat'ish, but I too worry about them fixing the results, ever-so-marginally, in critical venues. Ever been hustled by a good pool shark? Cat always seems to be just one ball better than you. But, as you're getting your wallet cleaned out, you keep thinking you're still in the game. He's just lucky.

Rove fully understands the stakes. I've not the slightest doubt he'll command whatever illegal and unethical shit it takes to prevail.
