The Military Commissions Act of 2006 (S.3930)

Section 7

(a)...‘‘(e)(1) No court, justice, or judge shall have jurisdiction to hear or consider an application for a writ of habeas corpus filed by or on behalf of an alien detained by the United States who has been determined by the United States to have been properly detained as an enemy combatant or is awaiting such determination. ‘‘(2) Except as provided in paragraphs (2) and (3) of section 1005(e) of the Detainee Treatment Act of 2005 (10 U.S.C. 801 note), no court, justice, or judge shall have jurisdiction to hear or consider any other action against the United States or its agents relating to any aspect of the detention, transfer, treatment, trial, or conditions of confinement of an alien who is or was detained by the United States and has been determined by the United States to have been properly detained as an enemy combatant or is awaiting such determination.’’.

(b) EFFECTIVE DATE.—The amendment made by subsection (a) shall take effect on the date of the enactment of this Act, and shall apply to all cases, without exception, pending on or after the date of the enactment of this Act which relate to any aspect of the detention, transfer, treatment, trial, or conditions of detention of an alien detained by the United States since September 11, 2001.

Retroactive absolution?

I suppose it can be argued that the low-level Graners and Englands et al are now retroactively indemnified by Bush's Torture Bill. The language is pretty clear.

That the largest, most expensive and sophisticated military in human history is dying a death of a thousand cuts at the hands of roaming bands of rag-clad irregulars mostly brandishing the crudest weapons this side of rocks and spears is simply mind-boggling, and could only have been accomplished by our incoherent, narcissistic, messianic dilettante-in-chief, a "man" madly in pursuit of the crowning failure of his failure ridden life. And, as usual, adults will be forced to come in and clean up after his sorry ass. It is really depressing, the international wreckage and carnage this idiot hath wrought. Osama's best friend by far.

Kerry, STFU!

When I heard about the latest John Kerry faux pas, I had to roll my eyes. If you’re gonna try to make a snide — if accurate — point about the incompetent Gaffer-in-Chief, somebody, SOMEBODY in your entourage had better make sure there will be no lexical/interpretive uninsured-motorist fender-bender like this one was. The Bush Whisperer, Karl Rove, was just given a huge gift. The timing is really bad. The right wing spin machine is gonna run with this right to election day, substantive irrelevance notwithstanding. Maybe Rush Limbaugh will even now offer up a two-fer comprised of Michael J. Fox jerkily making Kerry's ill-advised statement.
