"good Samaritan law"

Perhaps DA Carr or any incoming DA should watch "The Accused"http://en.wikipedia.org/wiki/The_Accused and then read the account of the "Creep on campus"

about David Cash (Berkeley Student) who stood by and watched as a 7 year old was assaulted by Jeremy Strohmeyer and ultimately killed. As the story states he even considered profiting from the killing!

California then passed SB80 http://info.sen.ca.gov/pub/99-00/bill/sen/sb_0051-0100/sb_80_cfa_19990607_105155_asm_comm.htmlthat made it a legal requirement to report such acts to the police, although I feel it falls short as the age cut off is 14. I believe it should be changed to 17 and that just as Johns names are publicized that so should inept individuals that sit there while a crime is being committed. In fact the fact that they stood there in approval makes them complicit to the ACT.

Also, how can a DA feel justified in prosecuting murder cases with just eye witness accounts as the Sheriff has stated they collected enough evidence and is just as concerned as all other citizens in the Bay Area and now nationally.

I commend the young women for rescuing this minor from further attacks, humiliation by degenerates. They are the heros, they have chosen to take a stand, if someone within the crowd in Iraq had done like wise perhaps that teenager would not have been stoned to death.

It makes me angry to see comments that even consider "If she was a slut". This is truly a sad statement in a society that seeks to be a social model to others.

Also, I think it behooves DA Carr to do full disclosure as to the fact that two of the attorneys representing two of the "alleged" students made large contributions to her campaign. Also, has she spoken to any of them? Perhaps there should be a grand jury investigation into this case for the sake of all rape victims and for the sake of the trust society has to place in a DA to do the just and proper thing by and for the people. Is it now true that in court is states "The people vs" when prosecuting.

In the San Francisco Chronicle it headline states:"Alleged rape victim wants day in court-D.A. should give it.

Are you listing Attorney General Brown? Is anyone listing? We don't need a society that protects the likes of a David Cash.

Does anyone care that the witnesses were threatened?

This is no Duke Lacrosse Athletes case. Here you have three women who broke through a door to get to the 17 year old. The more I read the sicker I got. As to witnesses, well if these three were threatened I imagine that the others that watched and cheered were too. Also, I imagine that they would look like a bunch of jerks for watching and for doing nothing to stop it. Since the teenager is described as looking comatose! Wow, this truly suggests to the DA that she gave consent? Where are the local politicians on this, where is Governor Arnold. Are there no legal safety nets for this sort of injustice?

They could have very well killed this teenager given her alcohol level and that she was not awake. Gee, I am sure there is some law on assaulting a person while they are not aware and locking them in, preventing others from assisting her, it would seem she was in need of medical assistance. Also, why did District Attorney Carr not prosecute those threatening the three women for intimidation of a witness? I thought that was a crime.

So, the owner of the house is rich, so the parents are rich, so the District Attorney is looking as is there is one justice for the rich and another for the poor. What does that say about society when we can't protect the most vulnerable and weak? Not much!

They say a picture is worth a thousand words, well here we have the details from two witnesses which paints a not too pretty picture in Santa Clara County and leaves one wondering if the D.A. interviewed these two or read their statements. I would think that this is of concern to all as we all have mothers, sisters and daughters.

Horrific indeed!

It is a horrific account and that of the on-going threats to the witnesses that rescued her. Rape, gang Rape!

In the interview with the two witnesses you get the the sense that this teenager feels that not everyone chose to look the other way. I am sure there will be more revelations today. In the morning news today (May 4th)it was finally reported that the witnesses were threatened.

Slow but sure the truth will trickle out.

True Heroines indeed!

April Grolle, Lauren Chief Elk and Lauren Breayans are true examples of intelligent, brave and articulate young women. BTW if the D.A. bothered to listen, Breayans stated she could ID one of the men who sexually assaulted the young girl. Amazing how they can charge some one with murder with eye witness ID but not rape.

These young women are strong and deserve all the support, given the threats they received and I imagine will continue to receive since they are continuing to speak out. Someone has to try this case.

They deserve some level of recognition for daring to step up, risking their own well being and dared to face what ever came their way to stop the savage, violent rape of a teenager who was unable to defend herself.
