Not necessarily pertinent...

...since we know the perps. The hippy family outside of provo will buck up when theirstate takes a hit...the mormons who lose a little money will just utilize some of their seven-year supply of food.

And part of what this is about has to be that a religiously-controlled state attacked another based on religion. It's not like they were involved in a water war.

We can write about anything out there, we just can't steal. the "immediacy" rule is the point to copyright, and I'm an old academician and an ace on that point.

check your e-mail, btw.

Glenn...

thanks for the chuckle.

Off topic, but I'm wondering if you'll be commenting during Andrew's absence on how media is being so relatively quiet regarding Treasury's change to Section 382 of the tax code. There should be a lot more talk going on about it, especially considering that...um...Treasury can't do that, as it's up to Congress write/change law. (And of course we need to be discussing why they're not talking much about it either.)

It seems a lot of the banking-savings deals everyone is hinging a recovery in that sector on is predicated on massive tax-cuts for banks resulting from Treasury's change to 382. And if the change gets scuttled, those deals being brokered could well be in danger; and it seems that's why everyone is being so quiet about it -- they want the deals to go through.

No...

...Glenn was right on about this.

"Nonetheless, we have strayed indescribably far from the system of Government we were supposed to have. That we trust a particular President and believe he'll do good things, achieve good outcomes, with excessive power is no reason to be happy with that state of affairs. As is often the case, Democratic Congressional leaders seem far more content to submit to power than to exercise it. But we shouldn't treat the framework created by the Constitution as optional or waivable when it seems there are good things to be gained by doing so."

We shouldn't treat the framework that way, the Senate shouldn't, and for goodness' sake neither should That One.

I was never happy about Bush's Executive Power Grabs, but I'll be even unhappier about such shenanigans if they continue in what promises to be a better administration. End and means.

BTW, those Executive Orders have been issued since 1789 based solely on these parts of the Constitution:

Constitution, Article II, Section 1, Clause 1:

Clause 1: Executive power

The Executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice-President chosen for the same Term, be elected, as follows:

Section 3: Presidential responsibilities

He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient;

he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper;

he shall receive Ambassadors and other public Ministers;

he shall take Care that the Laws be faithfully executed, and

shall Commission all the Officers of the United States.

Drilling down...

...further:

he shall take Care that the Laws be faithfully executed,

is really from where the authority for Executive Order is presumed.
